RE:
Request that the Board waive the $280 and $500 campaign finance late fees assessed against Cornell Dukes, a candidate for New Roads Mayor in the November 4, 2014 election and for Pointe Coupee Police Jury, District 8 in the October 24, 2015 election, whose 2015 Supplemental and 10-P campaign finance disclosure reports were filed 7 and 114 days late, respectively.
Facts:
In connection with his request that the Board waive the late fees assessed for the late filing of the reports, Cornell Dukes states that the 2015 supplemental report was filed late because he was unaware that he needed to file because he only had outstanding loans. He states that he did not realize that he owed the 10-P report until he looked at the filing schedule after depositing a check over $200.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205D provides that an automatic late fee shall be rescinded by staff if the candidate officially withdrew with the Secretary of State from the election and received no contributions or loans and/or made any expenditures, excluding the qualifying fee.

Recommendations:
Suspend all but $100 for the 2015 supplemental and suspend all but $100 for the 10-P report based on future compliance. The late fees must be paid within 30 days or the suspended portion becomes due and owing.
