RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Quinten Adcock, a candidate for Iberia Parish School Board, District 9 in the November 4, 2014 election, whose EDE-P campaign finance disclosure report was filed 326 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Quinten Adcock states that he is a single father of two young girls and is a casualty of the oilfield and living on a fixed income. He states that he is a first-time candidate who was overwhelmed by the amount of paperwork. His campaign was mostly self-funded and he did the best that he could to file the reports timely.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205D provides that an automatic late fee shall be rescinded by staff if the candidate officially withdrew with the Secretary of State from the election and received no contributions or loans and/or made any expenditures, excluding the qualifying fee.

Recommendations:
Suspend all but $100 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
