RE:
Request that the Board waive the $600 campaign finance late fee assessed against Barry Ivey, a candidate for State Representative, District 65 in the March 2, 2013 election, whose 2015 Supplemental campaign finance disclosure report was filed 10 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, report preparer, Nikki Sykora, states that the Barry Ivey Campaign should have filed two campaign finance reports for two separate elections by February 16, 2016. One report was for a past election that has no current activity and only reports outstanding debts to the candidate, while the other report contains all of the candidate's current year receipts and disbursements. Due to an oversight, the report with activity was omitted and not received by the due date.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205D provides that an automatic late fee shall be rescinded by staff if the candidate officially withdrew with the Secretary of State from the election and received no contributions or loans and/or made any expenditures, excluding the qualifying fee.

Recommendations:
Suspend all but $200 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
