| Advisory Opinion request regarding whether the Code of Governmental Ethics prohibits Clayton Chief of Police, Bobby Madison, from hiring the Mayor's sister, Minnie Turner. |

Chief Madison provided that he would like to hire Ms. Turner to serve as his clerk. Ms. Turner is the sister of the newly-elected Mayor Josephine Taylor Washington. Chief Madison stated that he has full power to hire, fire and set the salary for the police department employees without approval of the Board of Alderman or the Mayor.

La. R.S. 42:1119A provides that "No member of the immediate family of an agency head shall be employed in his agency."
La. R.S. 421112B(1) provides that no public servant shall participate in a transaction involving the governmental entity, in which to his actual knowledge any member of his immediate family has a substantial economic interest.
