Advisory opinion regarding whether an Assistant Attorney General assigned to the Office of Worker's Compensation Administration may be hired as the executive Director of the Second Injury Board for the Office of Worker's Compensation Administration.
Facts:
The Office of Worker's Compensation Administration contracts with the Attorney General's office for the legal services of three attorneys, known as Inter-Agency Transfers. These attorneys handle all litigation appeals of the Second Injury Board and provide additional legal assistance to the office as needed. The Second Injury Board is under the purview of the Office of Worker's Compensation Administration. The Director of the Office of Worker's Compensation Administration would like to consider one of the Inter-Agency Transfers assistant attorney generals for the Executive Director position for the Second Injury Board. The Director is concerned the attorney-client relationship would prohibit the assistant attorney general from accepting the position.

Further, the statute regarding the appointment states that the Executive Director shall devote full time to his duties and may not accept or engage in additional employment of any kind. The Director seeks guidance on whether the assistant attorney general is prohibited from performing other duties assigned within the agency that may not directly relate to his duties as Executive Director of the Second Injury Board and whether he may continue to engage in litigation on behalf of the Second Injury Board.


Recommendations:
Decline to render an opinion for lack of jurisdiction and direct the person requesting the opinion to the Louisiana Disciplinary Board and the Attorney General's Office.
