Education Explosion is a Louisiana non-profit which operates Impact Charter Elementary School, a Type 2 charter school authorized by the Louisiana Board of Elementary and Secondary Education in 2013. Education Explosion would like to promote Eric Scott to principal of its elementary school. Mr. Scott was initially hired by Education Explosion in 2011 as a Master Teacher to work in after school programs with schools in various school districts, and he has been employed as a certified classroom teacher at Impact Charter School since 2014. Mr. Scott, who has a Master's Degree in both Educational Leadership and Educational Technology, is certified to teach and to be a school administrator in Louisiana. Mr. Scott is the spouse of Chakesha Scott, the CEO of Education at Education Explosion. Mrs. Scott was appointed as CEO of Education at Education Explosion in August 2013 when Impact Charter Elementary School was first approved. However, Mrs. Scott did not officially become an employee of Education Explosion until June 2014.



Disqualification Plan

Chakesha Scott, as the CEO of Education at Education Explosion, will have no supervisory or managerial authority over Eric Scott with no input into decisions regarding his rentention, salary, discipline or any matters related to his employment at Impact Charter Elementary and/or Education Explosion, Inc.

Law:
La. R.S. 42:1119B prohibits an immediate family member of a member of a governing authority or the chief executive of a governmental entity from being employed by the governmental entity.

La. R.S. 42:1119B(2)(a)(v) provides a limited exception to the general nepotism prohibition and allows an immediate family member of a member of a local school board or of a superintendent who is employed as a classroom teacher to be promoted to an administrative position provided that he has the appropriate qualifications and certifications for such position.

La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1112C provides that every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of Section 1112 would result.

Recommendations:
Adopt the proposed advisory opinion and approve the disqualification plan.
