Advisory opinion request by C.R. "Robby" Miller, Tangipahoa Parish President, regarding whether Bean Town may enter into a contract with Vintage Market Days to be a vendor in the Florida Parishes Arena.
Facts:
Tangipahoa Parish Government owns and operates the Florida Parishes Arena. According to its website, Vintage Market Days (Vintage) is a company that hosts vintage inspired indoor/outdoor markets that allows vendors to display their talents and passions in creative venues. Vintage has entered into a leasing agreement with the Tangipahoa Parish Government to hold an event that will include approximately 100 vendors. Tangipahoa Parish employees are in no way participating in hosting the event with the exception of being a concession stand vendor.


Robby Miller is the Tangipahoa Parish President. Vintage has asked Bean Town, LLC a franchise of and d.b.a. PJ's Coffee of New Orleans (Bean Town) to be a vendor for their event. The cost charged by Vintage to Bean Town to be a vendor is $185. The price charged for the booth is based on a "rate card" for the size of the booth and whether there is a need for electricity. Mr. Miller's wife, Donna Miller, wholly owns Bean Town.

Law:
La. R.S. 42:1113A(1)(a) of the Code prohibits a public servant, a public servant's immediate family, or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed advisory opinion.
