RE:
Advisory opinion request by Lisa Schilling, on behalf of South Central Louisiana Human Services Authority (SCLHSA), regarding whether state employee may perform the same services for SCLHSA privately to the Disability Determination Services Office.
Facts:
Dr. Stephany Hillman is employed by SCLHSA as a psychologist 4. In her position, she provides psychological testing and evaluation services for those individuals seeking to file for disability under the Social Security Administration. SCLHSA holds a contract with the Disability Determination Services Office to provide such services.

Dr. Hillman has entered into a private contract with the Disability Determination Services Office to provide, in her private practice, the same psychological testing and evaluation services to the same client population that she provides for SCLHSA. As of the date of the initial request, Dr. Hillman has not yet seen any client for these services in her private practice.


Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
