RE:
Request that the Board waive the $600 and $2,500 campaign finance late fees assessed against Trina Chu, a candidate for Judge, Court of Appeal, 2nd Circuit in the March 5, 2016 election, whose 10-P and 10-G campaign finance disclosure reports were filed 6 and 112 days late, respectively.
Facts:
In connection with her request that the Board waive the late fees assessed for the late filing of the reports, Trina Chu states that for the 10-P report she mistakenly thought that the 10-P report was filed, but she had actually filed a 2015 supplemental report for a different election.She states that she created the 10-G report timely, but figured out later that she had failed to press the "submit" button. She did not receive a delinquency notice and did not realize that the report had not been filed until she spoke with someone at the Ethics Board and was told that it was never submitted.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive for the 10-P report. Suspend all but $500 for the 10-G report based on future compliance. The fine is payable within 30 days or the suspended portion becomes due and owing.
