RE:
Request to clarify previous advisory opinions regarding an outside employment opportunity for Stacie Massey, an employee of Department of Natural Resources, Office of Conservation, Shreveport District, with Theophilus Oil, Gas and Land Services.
Facts:
Stacie Massey is employed by DNR, Office of Conservation, as a Mineral Production Supervisor in the Shreveport District. Ms. Massey supervises employees who audit monthly oil production reports. She is also a part time courier for Theophilus Oil, Gas, and Land Services, LLC. Her job duties include bringing approved leases to various courthouses to be recorded. Ms. Massey makes these deliveries on her days off. Ms. Massey also performs GIS analyst services for Theophilus Oil, Gas and Land Services. These duties include drawing plats for the bids and nominations that will be turned over to Department of Natural Resources, Office of Mineral Resources.
Theophilus Oil, Gas, and Land Services is a consulting company that prepares and turns in bids and nominations to the Office of Mineral Resources.

Comments:
In prior opinions issued by the Board, the Board advised that Ms. Massey could remain employed with the Office of Conservation, Shreveport District, while accepting employment with Theophilus Oil, Gas, and Land Services as a courier and GIS analyst since Theophilus transactions involved the Office of Mineral Resources, not the Office of Conservation. Now, Theophilus Oil, Gas, and Land Services may branch out to the production side of the business and may provide production research for the Office of Conservation, Lafayette District.
Law:
R.S. 42:1111C(1)(a) of the Code prohibits a public employee from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

R.S. 42:1111C(2)(d) prohibits a public servant from accepting any thing of economic value for or in consideration of services rendered from a person who has or is seeking to have a contractual, business, or financial relationship with the public servant's agency.

Recommendations:
Adopt proposed advisory opinion.
