| Advisory opinion request regarding whether David Hayes, a former employee of Louisiana Economic Development, may contract with the local Louisiana Career and Solutions Center to provide training for their staff and clients. |

David Hayes was employed until April 29, 2016 with Louisiana Economic Development (LED), which was created pursuant to La. R.S. 36:101, et seq., as the Regional Project Manager for LED FastStart in Lake Charles. As such, Mr. Hayes supervised the training specialist and managed all of the independent contractors who were responsible for developing content and materials and facilitating industrial related training for companies that received FastStart services as part of an incentive package from LED.
If Mr. Hayes is allowed to contract with the Center, he would be providing training with a focus on leadership and employee development for its staff and clients, which includes job seekers and students. The Center is part of the Louisiana Workforce Commission, which was created pursuant to La. R.S. 36:301, et seq.

La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
