RE:
Request that the Board waive the $1,000 and $400 campaign finance late fees assessed against Donald "Don" Cravins, Sr., a candidate Mayor / City of Opelousas, St. Landry Parish, in the November 4, 2014 election and October 2, 2010 election, whose 2015 Supplemental campaign finance disclosure report has not been filed to date (November election) and 2015 Supplemental campaign finance disclosure reports was filed 17 days late (October election).
Facts:
Donald Cravins, Sr.'s, attorney, Benjamin O. Burns, states that the 2015 supplemental report for the 10/22/2011 and 11/4/2014 elections, were an error by the preparer of the reports. He overlooked his responsibility and was discharged. The replacement accountant promptly made the requisite filing through the electronic filing system. He was shocked to find out that the report did not go through. Upon his belated recognition of the failure, he completed the filing. The oversights are a result of human error and not a purposeful intent to avoid mandated filings.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205D provides that an automatic late fee shall be rescinded by staff if the candidate officially withdrew with the Secretary of State from the election and received no contributions or loans and/or made any expenditures, excluding the qualifying fee.

Recommendations:
Decline to waive for both 2015 supplemental reports for the November 4, 2014 election and the October 2, 2010 election.
