RE:
Request that the Board waive the $2,000 campaign finance late fees assessed against Monique Y. Metoyer, in her capacity as a candidate for District Judge / 9th Judicial District Court, ES 1, Div. A in the November 4, 2014 election, whose 2015 supplemental campaign finance disclosure report filed 234 days late.
Facts:
Monique Metoyer states she contacted our office to ascertain whether all of her campaign finance filings were up to date. She says she was informed by staff that they were in fact up to date. Ms. Metoyer also informed our office of her desire to take the remaining balance in her campaign account and donate it to a non-profit organization. She says she was informed that this was allowable and would be permitted, and further that all necessary reports were completed. On June 17, 2015, the balance of $581.23 was donated to St. James Memorial Catholic Church. She was under the assumption that her campaign was in full compliance. In March of 2015, she became unemployed and did not regain full-time employment until January 1, 2016. The fine would cause great hardship for her and she has earnestly tried to comply with all the rules of the Board.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
