Advisory opinion request by Dusty Cruse, Tullos Councilman, regarding whether he may be sponsored by the Tullos Police Department to attend the Police Academy.
Facts:
The Tullos Police Chief is an elected position, who would be responsible for writing the recommendation/sponsorship of Mr. Cruse to the Police Academy. The Tullos Council approves the budget for the Tullos Police Department and makes the decisions on whether the Tullos Police Department may add employees. However, the Tullos Police Chief may submit a budget request for adding more employees to the department. Mr. Cruse stated that he would pay for the attendance fees associated with the Police Academy. He would not be employed by the Tullos Police Department upon completion of the training. He stated that the dual office holding laws would prevent him from so doing.
Law:
La. R.S. 42:1113A(1)(a) of the Code prohibits a public servant, a public servant's immediate family, or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed advisory opinion.
