Consideration of a disqualification plan resulting from Michael Couvillon serving as Sheriff of Vermilion Parish while his wife, Sonya Couvillon, is employed with the Vermilion Parish Sheriff's Office.
Facts:
The disqualification plan submitted on behalf of Vermilion Parish Sheriff Couvillon is the result of his wife, Sonya Hudson Couvillon, being employed as a detective with the Vermilion Parish Sheriff's Office. The plan is to remove Sheriff Couvillon from any decisions regarding the supervision, evaluation, promotion/demotion, discipline, termination, or compensation of Detective Sonya Hudson Couvillon. The final decisions regarding the supervision, evaluation, promotion/demotion, discipline, termination, or compensation of Detective Couvillon shall be made by the Chief Deputy. The Chief Deputy may act upon the recommendations of Detective Couvillon's immediate supervisor, or may act independently of those recommendations. The plan further states that Sheriff Couvillon shall not be consulted or advised in advance of any such decisions. The decisions of the Chief Deputy on these matters shall be final as the decisions of the Vermilion Parish Sheriff's Office.
Law:
La. R.S. 42:1112B(1) provides that no public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1112C provides that every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result. The procedures for such disqualification shall be established by regulations issued pursuant to R.S. 42:1134(A)(1). The plan is to be developed in accordance with the rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.


Recommendations:
Approve the disqualification plan.
