RE:
PFD answer submitted by Cynthia Nuesslein, former member of the Bricolage Academy Charter School Board and the Louisiana Emergency Response Network Board, in response to a NOD requesting she amend her 2015 Tier 3 PFD.
Facts:
Cindy Nuesslein received a NOD requesting that she amend her 2015 Tier 3 annual pfd to file a 2015 Tier 2.1 annual pfd. Ms. Nuesslein filed an answer stating she is no longer on either board and is not required to amend. However, Ms. Nuesslein's service on the Emergency Response Network Board did not terminate until August 2015 and she is required to file a pfd the year following the termination of her service. Members on the Emergency Response Network Board are required to file under Tier 2.1. As such, she is required to file a 2015 Tier 2.1 pfd.

Further, since Ms. Nuesslein did not terminate her service on the charter school board until May 2016, she will be required to file a 2016 Tier 3 annual pfd by May 15, 2017.


Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Advise Cynthia Nuesslein of her filing requirements and that late fees may be assessed for the failure to file.
