Reconsideration request in connection with the Board's decision to decline to waive the $1,200 late fee assessed against Jack Blossman, Jr. for failure to timely file a Supplemental Lobbying Registration Report.
Facts:
Initial Consideration:

Mr. Blossman filed his Supplemental Registration report for St. Tammany Parish, 24 days late on March 10, 2016. He was assessed a late fee of $1,200. Mr. Blossman states that the parish president signed the contract on February 10, 2016, but that is not the date he got it from the parish. The purchase order from the parish was not even submitted until February 25, 2016. Mr. Blossman is not certain of the date he received the package with the signed contract. The 25th was a Thursday, maybe it took a couple of days to get it back and then it was mailed to him on March 2nd, and then it took a day or two for him to receive the package, Friday March 4th. He filed the registration report on March 10, 2016. The date falls within the 5 days in which to file the report, unless the weekend is counted, then its one day late. Mr. Blossman has included a copy of the purchase order from the parish.



Reconsideration Request: In Mr. Blossman's last letter, he stated that he wasn't certain of when he received the signed contract from St. Tammany Parish Government Legal Department. He has submitted the email from Lindsey Hardy in the Procurement Department, dated March 7, 2016. Mr. Blossman has since amended his registration to reflect the start date of his representation of St. Tammany Parish Government as March 7, 2016.

Law:
La. R.S. 24:53H Whenever any information contained in his registration changes, or the lobbyist begins representing an additional person, a supplemental electronic registration shall be filed with the board as soon as possible after such change occurs and in any event not later than five days after such change, using forms provided by the board.

La. R.S. 24:58D(1) Any person required to register and who fails to timely register and any person who fails to timely file any report required by this Part shall be assessed, pursuant to R.S. 42:1157, a late fee of fifty dollars per day.



Recommendations:
Decline to waive the late fee.
