Advisory opinion request as to whether Morgan Dixon may be employed as a firefighter with the Leesville Fire Department.
Facts:
Chief Kyle Bush is considering hiring Morgan Dixon to work as a firefighter at Leesville Fire Department. The Fire Chief of Leesville Fire Department has the sole authority to hire and fire employees and prepare their work schedules. Morgan Dixon's father, Captain Stacy Dixon, works at the Leesville Fire Department and supervises Shift 3. Morgan Dixon will not be placed under the supervision of his father and will be scheduled to work in either Shift 1 under the authority of Captain Eric Baker or in Schedule 2 under the supervision of Captain William Tibbitts.
Law:
La. R.S. 42:1119A prohibits an immediate family member of an agency head from being employed in his agency.

La. R.S. 42:1112B(1) prohibits a public servant from participating in a transaction involving his governmental entity in which a member of his immediate family has a substantial economic interest.

Recommendations:
Adopt the proposed advisory opinion.
