RE:
Request that the Board waive the $800 late fee assessed against Rufus Craig, in his capacity as a candidate for Mayor-President / Metro Council, City of Baton Rouge in the November 8, 2016 election, whose 90-P campaign finance disclosure report was filed 19 days late.
Facts:
Due to the historic flooding, he was not able to file the report. He planned to file the report timely, but his home began to take on water and the filing of the report slipped his mind. His home is located right on the Amite River and he was unable to leave his home for six days and did not have power. After receiving the letter reminding him of the requirements, he contacted the Board of Ethics the very next morning. Due to the unprecedented flooding he asks for leniency on any late fees that may have accrued between the 12th and 25th. He enclosed a check for $200 which is the late fee he would have owed if he had been able to file the report on August 12, 2016 as he had intended to do on that date.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.




Rule 1205C allows a late fee to be reduced to the amount of activity or 10 times the per day penalty, whichever is greater, if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed

Recommendations:
Suspend all but $200 based on future compliance. (Mr. Craig made a payment of $200 for this late fee)
