Request that the Board waive the $754 late fess assessed against Carol Ross, in her capacity as a candidate for Lafayette City-Parish Council, District 8 in the October 24, 2015 election, whose 2015 supplemental campaign finance disclosure report was filed 84 days late.
Facts:
Carol Ross states that her campaign volunteer, Peggy Castille, in charge of all campaign filings, had numerous problems with filing the electronic reports, including the supplemental report. She stated Ms. Castille spoke with Ms. Newsom on many occasions. There was no intent to violate the law. Numerous good faith attempts were made to correct the discrepancy and no expenses related directly to electioneering were paid after the election. Upon advice of Ethics staff, she closed the account with a donation to a church.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $100 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
