Advisory opinion request regarding whether the post employment restrictions in the Code of Governmental Ethics (Code) would prohibit Deborah Dees from being appointed to the Desoto Parish Communications District Board.
Facts:
Ms. Dees stated that her company, Deborah D. Dees, CPA, had a contract with the DeSoto Parish Communications District (District) to do bookkeeping, payroll, and issue monthly compiled financial statements. Ms. Dees tendered her resignation and dissolved her company's contract with the District effective August 31, 2016. Ms. Dees stated that currently her company is no longer associated with the District. She provided that the DeSoto Parish Police Jury appoints the board members to the District.
Law:
La. R.S. 42:1121B No former public employee shall, for a period of two years following the termination of her public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which she participated at any time during her public employment and involving her former governmental entity, by which she was formerly employed, or for a period of two years following termination of her public employment, from rendering any service which she had rendered to the agency during the term of her public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of her former agency.

Recommendations:
Adopt draft advisory opinion.
