RE:
Consent opinion regarding Dr. Peter Galvan, former St. Tammany Parish Coroner, using his position as Coroner for personal gain.
Facts:
Peter Galvan signed a consent opinion for violations of 1113, 1112A, 1111C(1)(a), 1116A, 1111A and 1112B(2) of the Ethics Code and paid a $2,500 civil penalty.


Law:
La. R.S. 42:1113 prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1112A prohibits a public servant from participating in a transaction involving his governmental entity in which he has a substantial economic interest.

La. R.S. 42:1112B(2) prohibits a public servant from participating in a transaction involving any person of which he has a substantial economic interest of which he may reasonably be expected to know.


La. R.S. 42:1116A provides that no public servant shall use the authority of his office or position, directly or indirectly, in a manner intended to compel or coerce any person or other public servant to provide himself, any other public servant, or other person with anything of economic value.

La. R.S. 42:1111A(1) prohibits a public servant from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

La. R.S. 1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and which the public servant has participated.

Recommendations:
Adopt and publish the consent opinion and dismiss the charges.
