Request that the Board waive the $400 campaign finance late fee assessed against Shannon James Gremillion, in his capacity as a candidate for Judge, Court of Appeal / 3rd Circuit, 1st Dist., Division C, in the November 8, 2016 election, and his committee, whose 180-P campaign finance disclosure report was filed 165 days late.
Facts:
Shannon Gremillion states that the 180-P report was not filed because there was no activity to report during the Jan 1, 2016 through the May 2, 2016 reporting period. As he understood "Schedule of Reporting and Filing Dates," no 180-P was required because the date of his campaign's first contributions/expenditures was after May 26, 2016. Specifically, as indicated in the 90-P, his campaign only received 2 contributions on May 15, 2016 and July 20, 2016. Expenditures through July of 2016 have been largely charitable donations, the earliest of which occurred on May 20, 2016.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $300 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
