RE:
Request that the Board waive the following late fees assessed against Committee for Better Schools in Calcasieu Parish, and its committee's chairperson, Paul Bonin, and treasurer, Winfield E. Little, Jr., for the May 2, 2015 Proposition Election: $1,000 for 30-E report that was filed 151 days late, $1,000 for 10-E report that was filed 131 days late, and $1,000 for 40-E report that was filed 81 days late.
Facts:
Donna Williams, as report preparer, states that she was not receiving monthly bank statements and was not aware of the three transactions that occurred in April and May 2015 as the committee treasurer requested that the bank mail the statements to the preparer's address in April of 2015. The address change was not completed by the bank until January of 2016 and incorrectly changed the address to 2540 W. McNeese instead of 540 McNeese. The bank corrected this error in August of 2016. Reports were filed as soon as she became aware of the transactions. Also, the committee started filing monthly reports in compliance with campaign finance rules and regulations as of September 2016.


The PAC does not have any money because all funds received were spent only for the purpose for which it was collected. He states that they have paid a preparer to complete the reports and deeply apologizes for the lateness of the reports.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $500 based on future compliance for the 30-E report. The late fee must be paid within 30 days or the suspended portion becomes due and owing.


Decline to waive for the 10-E and 40-E reports.
