Request to reconsider the Board's suspension of all but $250 in connection with a waiver request submitted by Thomas Randolph "Tom" Hanlon, former member of the South Burbank Crime Prevention and Development District, regarding a $1,500 late fee assessed for filing his 2013 Tier 2.1 annual PFD 148 days late.
Facts:


The Board suspended all but $250 at the July 2016 meeting. Mr. Hanlon states that he received no compensation for his service. He also states that he flooded during the August floods and he has no flood insurance.

Initial Information:


Mr. Hanlon states that he did not receive (or sign for) the NOD that was issued in April 2015. He states that upon review of the green card receipt, that his father signed for the notice, but his father never gave it to him. Mr. Hanlon states once he was contacted by agency staff, he immediately filed the PFD.

Mr. Hanlon further states that he thought he faxed the PFD prior to the original due date, i.e., May 15, 2014; however, he had no additional information to offer as to when it was faxed or from what fax number it came from.

Mr. Hanlon also states that while a replacement was not found until 2014, he did not attend any meetings after 2012 when his wife was diagnosed with cancer.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the reporting requirements under the Code of Ethics.
