Consideration of a disqualification plan submitted by the Iberia Parish Government regarding William Hulin and Christine Hulin, employees of the Iberia Parish Government.
Facts:
In 2013, more than a year following Christine Hulin's initial employment with the Iberia Parish Maintenance Department, her husband, William Hulin, requested an advisory opinion from the Board regarding his promotion to Facility Maintenance Supervisor. The Board advised that since his wife had been employed in the department for more than one year, he was not prohibited from being promoted to the position of agency head in her agency. The Board also approved a disqualification plan at the same time. However, the disqualification plan assigns an employee under Mr. Hulin's supervision to supervise his wife. The Board requested Mr. Hulin submit a revised plan that assigned all supervision of his wife's employment to a collateral employee or an employee in a higher position than Mr. Hulin. Mr. Hulin and Iberia Parish Government have submitted a revised plan delegating the authority over all personnel actions involving Ms. Hulin to the Chief Administrative Officer of Iberia Parish, Scott Saunier. Ms. Hulin's job description has been updated to account for this change.
Law:
La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.
Recommendations:
Approve revised disqualification plan.
