Request that the Board waive the $600 campaign finance late fee assessed against Lonny Myles, in his capacity as a candidate for City Judge, City Court, City of Zachary in the November 8, 2016 election, whose 30-P campaign finance disclosure report was filed 27 days late.
Facts:
Lonny Myles states that his office flooded in August. When notified by the Ethics Commission that he failed to timely file, he contacted the office via telephone and was told he could fax the report. That was done immediately. Then he received another notice that the information was incorrect and the fees continued to accrue. He refiled the report electronically as soon as he was notified. Mr. Myles was under the impression that he was only required to file his report with the LA Supreme Court, which he did. Having no opponent, nor any expenditures nor receipts, he was not aware he needed to file.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all based on future compliance.
