RE:
Request that the Board waive the $2,000 campaign finance late fee assessed against Blake Miguez, candidate for State Representative / 49th Representative District in the October 24, 2015 election, whose 2015 supplemental campaign finance disclosure report was not filed, but the 2015 Annual report was filed on November 2, 2016.
Facts:
The late fee assessment order was the first correspondence that he received on the matter of failing to file a 2015 annual campaign finance report. He did not receive the first notice letter, which to his understanding is a normal practice sent within days after a failure of filing occurs. Mr. Miguez states he was under the impression that his staff had handled the filing while he was in Baton Rouge for a legislative session. The report was not filed due to unusual circumstances that his assistant was dealing with at the time. After receiving the late fee assessment order, the 2015 Annual report received immediate attention and was filed on 11/3/2016. Completing the reports are a new process for him and his staff, but he will continue to strive to timely and accurately file in the future.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $300 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
