Waiver request submitted by Patrick Charles Williams, former State Representative - District 4, regarding a $200 late fee assessed for filing his 2015 Tier 2 annual PFD 2 days late.
Facts:
Mr. Williams states that when his term ended in January 2015 he was not aware of his requirement to file a disclosure statement for those few days. Mr. Williams explains that he has been working out of Dallas and he did not personally receive the NOD-FF (that was sent to his Shreveport address) asking that he file the PFD. He confirms that the Old Mooringsport address (in Shreveport) is the correct address and asked that it remain on file.

Mr. Williams also states his wife recently told him that he received a notification from the post office about needing to pick up a certified mail piece from the Ethics Board. On 11/28/16, Mr. Williams contacted this office and was told that a late fee had been issued and was ready for pick up at the post office. Mr. Williams states that he was in Baton Rouge and would pick up the notice/order personally.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
