Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Blake Beldsoe from purchasing a 10 acre tract of land from the DeSoto Police Jury while his father John Bledsoe serves on the E-911 Board.
Facts:
Gary Evans, the District Attorney for DeSoto Parish, provided that the E-911 Board is part of DeSoto Parish Government as it was created by the Parish and its members are appointed by the Police Jury. Mr. Evans stated that Mr. John Bledsoe was appointed by the Police Jury to serve on the E-911 Board. Additionally, he provided that the 10 acre tract of land is part of an industrial park owned by the Parish and the E-911 Board has no control over the Industrial Park.
Law:
La. R.S. 42:1113B provides that no appointed member of any board or commission, member of his immediate family, or a legal entity in which he has a substantial economic interest shall bid on or enter into or be in any way interested in any contract, subcontract or other transaction that is under the supervision or jurisdiction of the agency of such appointed board member.
Recommendations:
Adopt draft advisory opinion.
