Advisory opinion request by Shawn Toranto, Chief Executive Officer of Einstein Charter Schools, regarding whether it would be a conflict of interest for David Alvarez to provide services to Einstein Charter Schools through a federal grant while Mr. Alvarez is a candidate in an election to become an Orleans Parish School Board member or serves in such capacity.
Facts:
Mr. Alvarez was a candidate in an election to become an Orleans Parish School Board member. In 2016, Einstein Charter Schools retained the services of Evaluation Insights to provide third party evaluations for a federal grant it received in 2015. The contract entered into with this vendor named David Alvarez as a principal and is in excess of $75,000 for services to be rendered over the course of a year. However, Mr. Alvarez was unsuccessful in his election to the Orleans Parish School Board. Your request is now moot as the underlying issue is no longer applicable.
Law:
La. R.S. 42:1113A provides that no public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
