Advisory opinion request regarding whether John Broussard, an Assistant State Treasurer, would be prohibited from accepting the Executive Director position with the Louisiana Municipal Police Employees' Retirement System.
Facts:
Louisiana Municipal Police Employees' Retirement System (MPERS) was created pursuant to La. R.S. 11:2211, et seq. John Broussard is currently employed as an Assistant State Treasurer with the Louisiana Department of the Treasury (Department). He was previously authorized to serve as a designee of State Treasurer John Kennedy on the Board of Trustees of MPERS (MPERS Board). Since the State Treasurer became an ex officio member of the MPERS Board in 2011, five different employees of the Department have attended the monthly meetings as a designee of the State Treasurer as your schedules permitted. As such, from February 11, 2015 through April 20, 2016, Mr. Broussard has attended eight MPERS meetings. However, he is no longer a designee of the State Treasurer on the MPERS Board.

Comments:
In BD 2003-969, the Board found that J. Cooper Harrell, who, as Assistant State Treasurer, occasionally attended meetings as an ex-officio member of the Board of Trustees of the state's four retirement systems, was not considered a member of those boards subject to the restrictions in Section 1121A.
Law:
La. R.S. 42:1121A(2) prohibits a former member of a board or commission, for a period of two years following the termination of her public service on such board or commission, from contracting with, being employed in any capacity by, or being appointed to any position by that board or commission.
Recommendations:
Adopt the proposed advisory opinion.
