Request that the Board waive the $420 campaign finance late fee assessed against Bruce M. McCarthy, a candidate for City Marshal, City Court, City of Winnsboro in the November 8, 2016 election, whose 30-P campaign finance disclosure report was filed 7 days late.
Facts:
Bruce McCarthy states that, after qualifying, he had no opposition so he contacted the Ethics Board and spoke with someone on August 9, 2016, who advised him to go to the Leaders program to complete the necessary form online. He states that he filled out the form and thought he had completed the filing of the form. He states he then received a letter from the Ethics Board stating that he did not file the necessary paperwork. He called back and spoke to the same person and was told that the 30-P report was there, but it had never been submitted.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
