RE:
Request that the Board waive the $780 campaign finance late fee assessed against James "Jim" Mora, a candidate for Councilman, Metro District 9 in the November 8, 2016 election, whose 10-G campaign finance disclosure report was filed 13 days late.
Facts:
Jim Mora states that he believed that all reports were filed on or before the deadlines. He received a certified letter from the Ethics Board in December, 2016 informing him that the 10-G report had not been filed. He immediately called the Ethics Office to explain that he had lost and was confused as to why he received the letter. He states that he was told the 10-G report was required to be filed even though he was not in the general election and it would serve as the final report. He states that he did not file the report late out of malice. He states that he simply did not know he was required to file the 10-G report because it was his first time running for public office.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
