RE:
Request that the Board waive the following late fees assessed against MIKE PAC, a political action committee, its committee's chairperson, Michael Walsworth and treasurer, Stuart Clason, in connection with the November 8, 2016 Primary Election: $3,000 for 90-P report that was filed 103 days late and $3,000 for 10-P report that was filed 21 days late.
Facts:
Mike Walsworth, chairperson, states that he believes the 10-P report was required due to a $2500.00 contribution given to Bodi White, a candidate for Mayor - President of East Baton Rouge. He states that the MIKE PAC filed the 30 -P report, which covered all activity from January 1 to September 9, 2016. He states that at no time did MIKE PAC try to hide the contribution and the 90-P and he states the 10-P reports were immediately filed when they were notified by the board of the delinquency.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $500 for the 10-P report based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.

Decline to waive for the 90-P report.
