Untimely waiver request from Don Marshall, a candidate for Constable, Tangipahoa Parish, 8th Ward, in the November 4, 2014 election, whose EDE-P campaign finance report was filed 7 days late.
Facts:
Don Marshall states that he filed the EDE-P report immediately after he received a letter from the Ethics Board advising him that the report was not filed. He states that he did not realize that he had been assessed a late fee until he received a letter from the Attorney General's Office regarding the fine.

Mr. Marshall explained that he did not receive the late fee order that was sent by certified mail. He and his entire family were in Disney World at the time the letter was sent to his home. He states that he spoke with the Post Office and the postal carrier admitted that she signed for the certified mail on his behalf.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Consider the waiver request since it appears Mr. Marshall did not receive the late fee order.

Suspend the late fee for the EDE-P report based on future compliance.
