RE:
Request for approval of a disqualification plan, submitted on behalf of the Jefferson Davis Sheriff's Office, for those transactions involving the employment of Lisa Ivey within the Criminal Investigations Division while her father, Christopher Ivey, serves as Chief Deputy of the Jefferson Davis Sheriff's Office.
Facts:
The proposed disqualification plan would have Commander Ramby Cormier serve as direct supervisor of Lisa Ivey as the Commander of the Criminal Investigations Division. He would be involved in the decisions about promotions, salary increases, or disciplinary actions regarding Ms. Ivey. He would also report directly to Sheriff Ivy Woods on any and all employment issues for Lisa Ivey. Chief Deputy Ivey would be completely removed from all supervisory duties and/or authority as to matters affecting Lisa Ivey's employment, including disciplinary actions, promotions, and salary increases.
Comments:
The Board previously rendered an opinion in Board Docket No. 2016-1015 stating that Lisa Ivey's employment with the Jefferson Davis Sheriff's Office would not be prohibited.
Law:
La. R.S. 42:1112C provides that every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result. The procedures for such disqualification shall be established by regulations issued pursuant to R.S. 42:1134(A)(1).
Recommendations:
Approve disqualification plan.
