Advisory opinion request regarding whether RARR Maintenance, LLC, a company owned by Reginald Jordan, is prohibited from entering into certain contracts with the City of Shreveport, while his wife is employed with the City.
Facts:
Following the submission of this request for an advisory opinion, Reginald Jordan sold the company and accepted a job with the City. Mr. Jordan stated that RARR Maintenance, LLC, would be eligible for the contracts if his submission of the proposals prior to selling the company was not prohibited by the Code of Governmental Ethics. However, the Board does not render advisory opinions regarding past conduct and any question regarding future conduct is moot. The staff recommends to decline to render an advisory opinion.


Mr. Jordan submitted proposals to the City of Shreveport in response to RFP # 16-810 - Annual Care of Weed Abatement/Grass Cutting and RFP #16-812 - Annual Care of Premise (Clean-up) Season, on behalf of his company, RARR Maintenance, LLC. Mr. Jordan was informed by Gary Norman, Chief Building Official with the City's Department of Property Standards, that his company had been disqualified because of his wife's employment with the City Council's Office of Internal Audit.

Law:
La. R.S. 42:1112B(1) prohibits a public servant, except as provided in R.S. 42:1120, from participating in a transaction involving the governmental entity in which, to her actual knowledge, any member of her immediate family has a substantial economic interest.

La. R.S. 42:1113A prohibits a public servant, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Decline to render.
