RE:
Advisory opinion request as to whether Earl Davis may introduce a project for which he would be compensated by the Southside Economic Development District (SEDD) while he volunteers as an advisor to the SEDD.
Facts:
The Monroe City Council passed a resolution on February 10, 2015, forming a committee of the council to study and suggest solutions and direction and funding for economic development with focus on the area of the city, specifically but not limited to that of the southside district. Earl Davis is a professional consultant and was asked to volunteer his services as an advisor to the Southside Economic Development District (SEDD). However, the SEDD has not established an advisory committee and Mr. Davis has never been sworn in or given any official position, assignments, responsibilities or duties. Mr. Davis does attend meetings of the SEDD and offers advice. Mr. Davis would like to introduce a project to the SEDD and, if accepted, he would receive a commission.
Law:
La. R.S. 42:1102 (18)(a) "Public employee" means anyone, whether compensated or not, who is:
(i) An administrative officer or official of a governmental entity who is not filling an elective office.
(ii) Appointed by any elected official when acting in an official capacity, and the appointment is to a post or position wherein the appointee is to serve the governmental entity or an agency thereof, either as a member of an agency, or as an employee thereof.
(iii) Engaged in the performance of a governmental function.
(iv) Under the supervision or authority of an elected official or another employee of the
governmental entity.
Recommendations:
Adopt the proposed advisory opinion.
