RE:
Request that the Board waive the $2,000 and $2,000 campaign finance late fees assessed against Andrea Aymond, in her capacity as a candidate for District Judge / 12th Judicial District Court, Division A, in the November 4, 2014 election, the committee's chairperson, Thomas Garrot, Jr. and the treasurer, Carla Mayeaux, whose 2015 and 2016 Supplemental campaign finance disclosure reports that were filed 394 and 29 days late, respectively.
Facts:
Andrea Aymond states that she would have been timely in submitting these reports had she been physically able to do so. She states that she has only recently been able to work and to engage in the practice of law on a full -time basis since approximately October, 2016, as a result of health related issues that required multiple hospitalizations and resultant medical treatment.

She states that her lack of knowledge and experience with the process of running for political office, this being the first time running for political office, in conjunction with battling and trying to manage her illness diagnosed prior to the election and its recurring symptoms, resulted in her failure to timely file the 2015 Supplemental report. During the election, she stated that she had the services of someone with experience in campaigns who assisted in filing the requisite reports during the election. After the election, however, she stated she no longer had anyone there to assist in such matters and admits having no idea that supplemental reports were required to be filed after the election was concluded.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $200 for the 2015 supplemental report. The late fee must be paid within 30 days or the suspended portion becomes due and owing.

Rescind the late fee for the 2016 supplemental report.
