Request that the Board waive a $2,000 late fee assessed against Education Reform Now Advocacy and its committee's treasurer, Patrick Van Keerbergen, related to its participation in the November 8, 2016 election, whose 30-E campaign finance disclosure report was filed 93 days late.
Facts:
Margaret O'Meara, report preparer for Education Reform Now Advocacy (ERNA), states that the 30-E report was late because a former employee, who was in charge of the filings in October, failed to file the disclosure statement. Based on her understanding of the filing schedule, she states this was not a required report. While the letter notifying ERNA of the late filing appears to have been written on November 28, 2016, she states she was not aware of the matter until the letter was forwarded to her via e -mail in January. Upon learning of this mistake, she states that she immediately filed the report.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
