Advisory Opinion request of Nathan Dronette, former employee of GOHSEP, regarding post-employment restrictions.
Facts:
Nathan Dronette was previously employed with the Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP), from October 2010 until June 2016. During that time, he served in the Disaster Recovery Division as: (1) grant manager, reviewing grant documentation for compliance with regulations and processing payments requests; (2) insurance specialist, identifying insurance issues and implementing resolution strategies; and, (3) over-payment specialist, reviewing cross-disaster project funding to ensure identification of over-payments, repayment of funds, or initiation of a plan to resolve over-payments. During his employment with GOHSEP, Mr. Dronette did not participate, nor was he involved in the preparation or procurement of any contracts.

In June 2016, Mr. Dronette accepted a Business Analyst position with CB&I Environmental & Infrastructure, Inc. (CB&I), in its Program and Construction Management business line. On August 31, 2016, CB&I was awarded GOHSEP-CBI Technical Services Contract No. 4400009902 (Contract) to administer grant programs listed in the National Flood Insurance Act or the Robert T. Stafford Disaster Relief and Emergency Assistance Act in connection with all current federally declared disasters and any subsequently declared disasters. If allowed, Mr. Dronette will serve as a Public Assistance/Technical Assistance Liaison, on behalf of CB&I, providing data analytics, information technology enhancement, including development of software tools, and Public Assistance program and policy guidance under the Contract.

Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which he participated at any time during his public employment and involving his former governmental entity, or for a period of two years following termination of his public employment, from rendering any service which he had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of his former agency.
Recommendations:
Adopt the proposed advisory opinion.
