Advisory Opinion request of William McGoey, an Assistant District Attorney in the St. Bernard Parish District Attorney's office, as to whether he can bid on and purchase an adjudicated property from St. Bernard Parish Government.

NOTE: Mr. McGoey has asked to withdraw this advisory opinion request.

William McGoey is an Assistant District Attorney (ADA) in the Civil Division with the St. Bernard Parish District Attorney's office. The St. Bernard Parish Government (SBPG) operates an Adjudicated Properties program, pursuant to La. R.S. 47:2201, et seq., and has contracted with Civic Source, a private entity, to handle auctioning the adjudicated properties. Civic Source performs title research, sends legal notices, advertises the properties, and conducts the auction through its on-line computer auction services. Civic Source then selects the highest bidder, prepares the closing documents, conducts the closings, and remits any profit to SBPG.

As an ADA, Mr. McGoey notarizes the Parish President's signature on the Act of Sale documents and his paralegal sends the executed documents to Civic Source. Mr. McGoey advises SBPG regarding the Adjudicated Properties program and acts as a representative of SBPG for any issues with Civic Source.

Recommendations:
Allow the withdrawal of the advisory opinion request.
