Advisory Opinion request of Jennifer Jones, District Attorney for the 38th JDC (Cameron Parish), regarding the Cameron Parish Library Board of Commissioners Jaimie Boudreaux and Ernest Roberts.
Facts:
Tina Dupont Boudreaux and JoDee Reyes Roberts have been employed by the Cameron Parish Library system (Library) at the Grand Lake Branch since 1994 and 1995, respectively.

Jaimie Boudreaux, the husband of Tina Boudreaux, was appointed by the Cameron Parish Police Jury as a commissioner of the Library Board of Control (Library Board) on December 6, 2011, and re-appointed to a second term on January 25, 2017. His term expires on December 6, 2021.

Ernest Roberts, the husband of JoDee Roberts, was appointed by the Cameron Parish Police Jury to his first term as a commissioner of the Library Board on January 25, 2017. His term expires on December 6, 2021.

Law:
La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1102(13) defines "immediate family" as the term relates to a public servant to mean his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.

La. R.S. 42:1120.4 provides an exception for appointed members of a board or commission to recuse themselves from voting on matters that violate section 1112 of the Code. The appointed members may not discuss and debate the matter.

Recommendations:
Adopt the proposed advisory opinion.
