RE:
Request to waive the $750 late fee assessed against Mason Dupre for the late filing of the November 2016 Lobbying Expenditure Report.
Facts:
Mr. Dupre states that he had some rare extenuating circumstances as well as a past of timely/good reporting. He states that on October 23, 2016, he was arrested for what can be called a mental breakdown and detained until November 1, 2016; after which he he was transported from Los Angeles to New Orleans, where he then checked into the East Jefferson ER. He states that once he was released, he took a few days to get his feet back under him, but was able to file his September report then.

Mr. Dupre states that he spent the month of November trying to become acclimated with his new diagnoses and adhering to the regime of rest and medicine the doctor placed him under. He states that he had a bad relapse that landed him in two care programs, one of which made him unable to file his November report. He states that, like the September report, he received his mail and quickly submitted his report. Mr. Dupre states that this diagnoses has brought many hardships into his life ranging from relationships to financial, and he is kindly asking for leniency regarding the fines while he was dealing with the onset of a new disorder.

Comments:
Mr. Dupre submitted a waiver request for both the September 2016 and the November 2016 report; however, the waiver request for the September 2016 report is untimely. The information in bold in this section is with regard to the timely filed waiver request.

Law:
La R.S. 24:55 provides that a registered lobbyist shall file a monthly expenditure report by the 25th day of the subsequent month.

Rule 1205B allows the Board to rescind a late fee assessed because of a serious medical condition which prevented the filer from timely filing the report.

Recommendations:
Consider the untimely request for the September 2016 report; and, suspend all of the late fee based on future compliance. With respect to the November 2016 report, rescind the late fee pursuant to Rule 1205B.
