RE:
Request for approval of a disqualification plan regarding whether Roxanna Womack can continue her employment with the Denham Springs Police Department while her husband, J. Shannon Womack, serves as Police Chief.
Facts:
Shannon and Roxanna Womack were married on June 1, 2013. Mrs. Womack has been employed with the Denham Springs Police Department (Department) since July of 2012, and she currently serves as a Differential Response Officer. Finally, Mr. Womack was promoted from Police Captain to Provisional Police Chief on April 28, 2016, and is under consideration for appointment as the permanent Police Chief.

The Board, at its January 2017 meeting, considered these facts and advised that Ms. Womack's employment may be continue; however, a disqualification plan was required. Mr. Womack has submitted a disqualification plan stating that the Mayor of the City of Denham Springs will handle all issues allowing Mr. Womack to avoid a participation problem.

Law:
La. R.S. 42:1119A prohibits a member of the immediate family of an agency head from being employed in his agency.

La. R.S. 42:1119C allows a public employee that has been employed for at least one year prior to her immediate family member becoming the agency head to continue her employment and receive normal promotional advancements.

La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1112(C) allows a disqualification plan to be developed in accordance with Chapter 14 of the Rules for the Board of Ethics to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.

Recommendations:
Approve the disqualification plan..
