| Advisory Opinion request of Stephen Nunnery, Director of Administration for the City of Zachary, regarding the employment of his daughter by the City's Utility Department. |

Stephen Nunnery is currently the Director of Administration and Chief Financial Officer for the City of Zachary. His duties include supervision of budgeting, assisting and preparing for the annual audit, investments, accounts payable, and preparing financial statements. He is over the Finance Department.
ADDITIONAL INFORMATION:
Mr. Nunnery's daughter, Megan Nunnery, is currently a temporary cashier in the Utility Department for the City of Zachary. She is seeking to be promoted to a permanent position as a cashier. The Utility Department is under the supervision of the Meter Director, Monica Jackson, who handles all decisions regarding the employment of Megan Nunnery. Mr. Nunnery has no supervision or managerial responsibility over the Utility Department.

This matter was deferred in March to clarify and obtain additional information regarding Megan Nunnery's current employment position/status with the City of Zachary, which has been attached.

La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1102(13) defines "immediate family" as the term relates to a public servant to mean his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.
La. R.S. 42:1102(2)(a) defines "agency" as a department, office, division, commission, board, committee, or other organizational unit of a governmental entity.
