Advisory opinion request from Jeff Davis Water and Sewer Commission (Commission) regarding whether the Code of Governmental Ethics (Code) would prohibit the Commission from purchasing a vehicle from Gulf Coast Autoplex (Autoplex) while the Commission President, Greg Bordelon, is employed by the Autoplex.
Facts:
Advisory opinion request from David Trahan, Manager of the Jeff Davis Water and Sewer Commission regarding whether Code of Governmental Ethics would prohibit the Jeff Davis Water and Sewer Commission from purchasing a vehicle from Gulf Coast Autoplex while the Commission President, Greg Bordelon, is employed by the Autoplex. He provided that Mr. Bordelon is a part time employee of the Gulf Coast Autoplex, has no ownership interest in the Autoplex, and will not benefit or receive any commission for the sale of this vehicle.
Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant, or a legal entity in which the public servant exercises control, from receiving a thing of economic value for services rendered to any person whose conducts operations or activities that are regulated by the public servants agency has or is seeking to obtain a business or financial relationship with the public servant's agency.
Recommendations:
Adopt draft advisory opinion.
