Advisory opinion request from Shirley McCoy regarding whether the Code of Governmental Ethics (Code) would prohibit her, a Louisiana State Library employee, from becoming a featured author at the 2017 Louisiana Book Festival.
Facts:
Ms. McCoy provided that she is employed at the State Library as a Library Specialist 3 in the Circulation Department, which is under Access Services. She is also a published author and would like to submit an application to be selected as a featured author in the 2017 Library Book Festival.
Ms. McCoy stated that each year the State Library hosts the Louisiana Book Festival and the books are vetted by the selection committee. The Selection Committee members are selected from State Library Staff and the Louisiana Center for the Book Staff. Ms. McCoy provided that no employee from the Circulation Department or Access Services was selected to serve on the selection committee for 2017. Further, she stated that the application, to be selected as a featured author, is not processed in any way by the Circulation Department. Additionally, Ms. McCoy provided that each book is selected based on its own merit, not the identity of the author. There is no monetary compensation for the author if selected to participate.
Law:
La. R.S. 42:1113A prohibits a public servant's immediate family member or a legal entity in which he has controlling interest from bidding on or entering into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the public servant's agency
Recommendations:
Adopt draft advisory opinion.
