RE:
Request that the Board waive the $600, $300 and $2,000 campaign finance late fees assessed against Leander "Shane" Zanders, a candidate for Councilman, Metro District 12 in the November 8, 2016 election, whose 30-P, 10-P and 10-G campaign finance disclosure reports were filed 56, 5 and 54 days late, respectively.
Facts:
Leander Zanders states that he did not complete the campaign finance report forms on time for two reasons. The first reason he states is that he was under the impression that if no contributions were receive there was no reason to file. The second reason he states was that he found the entire reporting system very frustrating and confusing. After picking up his packet, he stated he left out of that office with no idea of what was expected or what to do going forward. He states that some people hire campaign managers to help them or someone who is knowledgeable, but not all candidates have that option. He states that it was only until someone from the Ethics office called him and helped with simple instructions that he was able to complete his reports.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Rule 1205D provides that an automatic late fee shall be rescinded by staff if the candidate officially withdrew with the Secretary of State from the election and received no contributions or loans and/or made any expenditures, excluding the qualifying fee.

Recommendations:
Suspend all but $200 based on future compliance for each of the 30-P, 10-P, and 10-G reports. The $600 in late fees must be paid within 30 days or the suspended portion becomes due and owing.
